The basis of the PROCESINVEST activities is a contractual obligation to cover all costs of the clients related to justified claim enforcements – most often by legal proceeding.
PROCESINVEST finance legal proceedings where a successful conclusion can be expected.
PROCESINVEST cooperate with the lawyers of the clients or as preferred by the client - with partner lawyers.
The service of financing the proceedings is provided to the clients free of charge. In case of unsuccessful enforcement of the claim, the client shall not be obliged to reimburse the costs paid by PROCESINVEST. PROCESINVEST bear all the risks.
PROCESINVEST shall receive a reward from the proceedings yield in case the proceedings are concluded successfully. The clients then usually obtain 60 up to 85 percent of their claims depending upon the value of the enforced claim.
The cooperation between the client and PROCESINVEST can be started at any time during the claim enforcement period.
On behalf of the clients, PROCESINVEST shall cover 1) initial claim enforcement in the Czech Republic and abroad through partner law offices, 2) costs of subsequent legal proceedings in the Czech Republic and abroad 3) eventual costs of distraint proceedings and execution.
- Benefits for clients:
- The service of financing claims is no credit neither a loan. The owner of the claim is not obliged to pay back anything.
- The service of financing claims is a business investment. Its returns when a yield is gained.
- In case of eventual unsuccessful conclusion of the proceedings, PROCESINVEST bears the full risk of additional costs. The clients do not pay back the costs of the lawsuit neither the costs to be paid to the counterparty.
- In case of successful enforcement of the claim, PROCESINVEST shall receive a percentage of the yield as a reward.
- At PROCESINVEST, each of the claims is subject to a thorough analysis. The decision for financing the legal proceeding of individual cases is made on the basis of the probability of successful litigation.
- In case the service of financing is not confirmed after the case analysis, the clients should consider whether to initiate the legal proceedings or not.
- However, granting the service of financing of the proceedings with a claim activation option, is a positive signal for the client.
- Benefits for lawyers:
- Pursuant to applicable laws, PROCESINVEST can arrange a share in successful conclusion of the litigation. However, we cannot provide legal representation neither legal consulting.
- Cooperation with external lawyers representing the their clients, is indispensable.
- A lawyer can offer the client to enforce a justified claim, which the client would not enforce due to insufficient finances or due to risks of eventual additional costs.
- The service of financing gives the lawyer a certainty of receiving continuous payments for services provided.
- The service of financing can extend the number of litigations conducted by the lawyer significantly.
